The Notice contains information about a proposed class action settlement with R.R. Donnelley & Sons Company and Precision Dialogue Direct, Inc. (“Defendants”). A proposed class action settlement has been reached in the case of Javier Trejo v. R.R. Donnelley & Sons Company and Precision Dialogue Direct, Inc., Case No. 2022 CH 08472, pending in the Circuit Court of Cook County, Illinois. On July 17, 2024, the Court preliminarily approved the settlement and, by agreement of the parties, certified this lawsuit to proceed as a class action for settlement purposes only. If, between August 26, 2017 through January 29, 2024, worked for one of the Defendants and used a fingertip-scan timeclock, you are a member of the Settlement Class. Excluded from the Settlement Class are (1) any Judge or Magistrate presiding over this Action and members of their families; (2) Persons who properly execute and file a timely request for exclusion from the Settlement Class; (3) those whose claims were released in Patricia Farias v. R.R. Donnelley & Sons Company, Case No. 20 CV 07468 (N.D. Ill.); and (4) those who signed a general release of claims relating to the closure of the Precision Dialogue Direct, Inc. facility.

The Notice is to advise you of the terms of the proposed Settlement, and your rights in connection with it. The Notice contains only a summary of the Settlement Agreement. Your legal rights are affected whether you act or don’t act. Read the Notice carefully.

The proposed settlement is not an admission of wrongdoing by Defendants, and Defendants deny that they violated the Illinois Biometric Information Privacy Act or any other law. The Court has not decided who is right or wrong. Rather, to save the time, expense, and distraction of litigation, the parties have agreed to settle the lawsuit.
